Terms & Conditions

Black Mountain Bikes and www.blackmountain.bike are trading names of Jennock Ltd. We recommend that you print out and keep a copy of these terms and conditions for future reference. These Terms and Conditions govern your use of our website. We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering. This does not affect your statutory rights.

Our Terms and Conditions are subject to change without notice.

This site is owned and operated by Jennock Ltd t/a Black Mountain Bikes (‘Black Mountain, Black Mountain Bikes, ‘we’ or ‘us’ or ‘our’). These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website.

THE CONTRACT BETWEEN US

Any contract for purchases made through the website will be with Jennock Ltd t/a Black Mountain Bikes. Black Mountain Bikes must receive payment of the whole of the price for the goods that you order (unless a deposit has explicitly been paid) before your order can be accepted, and the contract formed.

Once payment has been received Jennock Ltd t/a Black Mountain Bikes will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Jennock Ltd t/a Black Mountain Bikes acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

Black Mountain Bikes is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Any other use or reproduction of the material or content is strictly prohibited.
You may not create any link to this website without prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.
While we will use reasonable endeavours to verify the accuracy of any information we place on the Black Mountain Bikes website, we make no warranties, whether express or implied in relation to its accuracy.

PAYMENT DETAILS

Jennock Ltd t/a Black Mountain Bikes accepts payment by Visa, MasterCard, Switch, Maestro, Delta, PayPal, and Amex through PayPal. All product prices and delivery charges are shown in UK pounds sterling and are inclusive of VAT at UK rates, unless you use our currency switcher.

Jennock Ltd t/a Black Mountain Bikes takes responsibility to ensure that your payment is secure. We do this via secure payment pages and by secure PayPal servers.

Customers ordering from outside of the EU are responsible for any customs charges, including duty and VAT. Customers will be billed for any charges not paid.

AVAILABILITY OF GOODS YOU ORDER

If Black Mountain Bikes has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by us from your credit card will be re-credited to your account and Black Mountain Bikes will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Jennock Ltd t/a Black Mountain Bikes will not be obliged to offer any additional compensation for disappointment suffered.

Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.

DISCOUNTS

Any discounts used on orders placed on this website are honoured at our discretion. We reserve the right to withdraw or cancel any orders where we believe the discount has not been used in its proper manner, or for its true purpose. Discounts can only be used within the specified time frame, and cannot be used retrospectively. Any discounts offered are done so at our discretion and should be seen as a goodwill gesture, not a right.

CANCELLATION

Under the Consumer Rights Act 2015 you have the right to cancel your order within 14 calendar days.

VAT AND DUTY

We charge VAT at the current rate to the UK and to EU countries. No VAT is charged on goods with a shipping address outside of the EU. You are required to pay the relevant local taxes and duties. Failure to do so will result in the goods not being delivered and a re-stocking charge will apply.

EXTENT OF LIABILITY

The goods issued by Black Mountain Bikes are tested and dispatched in 90% assembled form. This requires the end user to assemble some simple parts of the bike. You will be notified of the basic tools required for assembly prior to your goods arriving. We strongly advise that a qualified bicycle mechanic assembles the bicycle, makes any checks and makes any changes required. Any worries regarding bicycle components should be investigated immediately and the bicycle should not be ridden until safety is confirmed by a qualified bicycle mechanic. In the instance of a product failing under normal warranty conditions, Jennock Ltd t/a Black Mountain Bikes will endeavour to compensate you for the failed parts.

Cycling is a dangerous activity. Always abide by the highway code, ensure you supervise your children on their bikes and make sure that they always wear a helmet.

You must follow the period maintenance checks as set out in the user manual.

Jennock Ltd t/a Black Mountain Bikes is not responsible for any harm, injury or death caused to yourself or any third parties when using products of Black Mountain Bikes.

CHANGES TO THIS AGREEMENT

Jennock Ltd t/a Black Mountain Bikes reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

 

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
